Implementation status. This replacement draft is intended to be published only after Ferrari Radiators verifies that its checkout, payment, shipping, warranty, consent, and privacy configurations match this text. Nothing in these Terms limits rights that cannot lawfully be limited.
1. Agreement to These Terms
These Terms and Conditions govern your access to FerrariRadiators.com, including the online shop, product pages, forms, content, and services offered through the website. By using the Site, placing an order, submitting a form, or accepting these Terms at checkout where that option is presented, you agree to these Terms and the policies incorporated by reference.
Please read these Terms together with our Shipping Policy, Returns and Warranty Policy, Privacy Policy, and Cookie Policy. Where a policy supplies a more specific rule for a purchase, shipment, return, warranty request, privacy choice, or cookie preference, that specific rule applies to the relevant matter.
2. Eligibility and Account Information
You must provide accurate, current, and complete information when you place an order or submit a request. You are responsible for safeguarding any account credentials that you create and for activity conducted through your account. You must notify us promptly through our specialist contact form if you believe an account, order, or payment interaction may have been used without authorization.
The Site is intended for individuals who may lawfully enter into a binding agreement. If you place an order for a business, you confirm that you have authority to bind that business to these Terms.
3. Product Information, Fitment, and Technical Content
Ferrari Radiators strives to present current descriptions, images, compatibility information, specifications, and pricing. Product photographs, finishes, dimensions, colors, and packaging may vary from the display on your device. Technical content is provided for general informational purposes and does not replace diagnosis, inspection, manufacturer service information, or the judgment of a qualified technician.
Vehicle compatibility can depend on model year, market, production date, trim, options, prior repairs, and component revisions. Before ordering, you are responsible for confirming that the product matches your vehicle and intended installation. If you need help identifying a product, use the specialist contact form before ordering. A product listing is not a guarantee that a part is appropriate for every vehicle bearing a model name.
Installation, pressure testing, coolant handling, electrical work, and cooling-system repair can involve safety risks. Use a qualified technician where appropriate and follow applicable safety procedures and vehicle-service information.
4. Orders, Pricing, and Availability
Submitting an order is an offer to purchase the selected item. Ferrari Radiators may accept, decline, limit, or cancel an order where permitted by law, including when an item is unavailable, product information contains an error, the order appears fraudulent, payment authorization cannot be obtained, or fulfilment is not possible.
Prices, taxes, shipping charges, delivery estimates, available payment methods, and applicable product options are shown at checkout or in the order flow. We may correct an obvious pricing, availability, or description error before shipment. If a correction affects your order, we will provide an appropriate notice and available options before completing the affected transaction where required by law.
Some products, finishes, special orders, freight shipments, or custom arrangements may require additional confirmation. If a post-order shipping, freight, tax, or configuration issue arises, Ferrari Radiators will contact you through the information provided with the order before taking further action where practical and required.
5. Payment, Fraud Prevention, and Taxes
Payments are processed through the methods made available at checkout. Your payment provider’s terms may also apply. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable payment processor to charge the approved amount, including applicable taxes, shipping charges, and other disclosed charges.
Ferrari Radiators may use reasonable fraud-prevention, security, and order-verification measures. We may request additional information reasonably necessary to verify an order before shipment. We do not ask for passwords or full payment-card numbers through the specialist contact form.
You are responsible for taxes, duties, customs charges, import fees, and other governmental assessments that apply to your order unless the checkout expressly states otherwise.
6. Shipping and Delivery
Shipping, processing, carrier, delivery, freight, tracking, customs, insurance, damage-reporting, address, and restricted-destination rules are governed by the Shipping Policy. Delivery dates are estimates unless a written agreement expressly states otherwise. Carrier delays, customs processing, weather, inaccurate address information, delivery restrictions, and other events outside reasonable control can affect delivery.
Please inspect a delivery promptly and retain packaging and shipping materials if an item appears damaged, incomplete, or incorrect. The Shipping Policy and Returns and Warranty Policy explain the process for reporting a shipment issue. Nothing in this section removes consumer protections that apply by law.
7. Returns, Refunds, and Limited Warranty
Returns, restocking charges, exclusions, return authorization, inspection, refund timing, transit-damage reporting, incorrect-item procedures, and warranty claims are governed by the Returns and Warranty Policy.
Ferrari Radiators offers a five-year limited seller warranty for eligible products as described in that policy. The limited warranty is a commercial warranty. It does not exclude, restrict, or replace any legal guarantee, implied warranty, statutory remedy, or consumer right that cannot lawfully be excluded or restricted.
8. Intellectual Property and Permitted Use
The Site and its text, graphics, photographs, product information, logos, videos, software, designs, and other content are owned by Ferrari Radiators or used with permission and are protected by applicable intellectual-property laws. You may use the Site for lawful personal or business purchasing and evaluation purposes. You may not reproduce, distribute, scrape, reverse engineer, frame, modify, create derivative works from, or commercially exploit Site content without prior written permission, except where applicable law permits the activity.
You may not use the Site to interfere with security, introduce malicious code, harvest personal information, submit deceptive orders, impersonate another person, violate another party’s rights, or engage in conduct that violates applicable law.
9. Brand References, Intellectual Property, Feedback, and Legal Compliance
Ferrari Radiators is an independent seller and service provider. References on the Site to Ferrari, vehicle models, original equipment, product numbers, or third-party brands are used only to identify vehicle applications, compatibility, or the source of a product reference. Those names, marks, logos, and other third-party intellectual property remain the property of their respective owners. Except where expressly stated in writing, no reference creates sponsorship, affiliation, approval, endorsement, dealership, agency, or authorization by Ferrari S.p.A. or another third-party rights holder.
If you provide a review, feedback, idea, suggestion, image, or other material through the Site, you represent that you have the right to provide it and that it does not violate another person’s rights, confidentiality obligations, or applicable law. You retain rights you may have in your material, but grant Ferrari Radiators a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and distribute it for operating, improving, supporting, and promoting the Site and its products, subject to the Privacy Policy and applicable law. Do not submit confidential information, passwords, full payment-card numbers, or material you do not have the right to share.
If you believe Site material infringes your copyright, trademark, or other intellectual-property right, submit a detailed notice through the specialist contact form. Identify the right you claim, the material at issue, the location of the material on the Site, your authority to act, and enough information for us to evaluate the request. Ferrari Radiators may request additional information and may investigate, remove, restrict, or restore material where appropriate. This contact route is not a representation that Ferrari Radiators has registered a designated agent, qualifies for a statutory safe harbor, or has adopted a formal notice-and-takedown process.
Ferrari Radiators may decline or cancel a transaction where fulfilment, export, import, sanctions, fraud-prevention, product-safety, carrier, legal, or compliance requirements make the transaction impracticable or prohibited. Ferrari Radiators is not responsible, to the extent permitted by law, for a delay or failure caused by events outside reasonable control, including carrier interruption, customs action, shortage, supplier disruption, labor disruption, cyber incident, natural event, governmental action, or infrastructure failure. This does not remove any remedy that cannot lawfully be limited.
10. Third-Party Services and Links
The Site may link to, embed, or interact with third-party services, including payment processors, carriers, social-media services, analytics providers, advertising services, and other tools. Third parties operate under their own terms and privacy practices. Ferrari Radiators is not responsible for third-party content, availability, practices, or transactions except to the extent responsibility cannot lawfully be excluded.
11. Privacy and Cookie Choices
Our Privacy Policy explains how Ferrari Radiators handles personal information. Our Cookie Policy explains cookies, similar technologies, preferences, and browser-based signals. When the Site displays a Cookie Settings or Manage Preferences control, use that control to review or change available choices. Requests about privacy, cookies, or consent should be submitted through the specialist contact form.
12. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Site and its content are provided on an “as available” basis. Ferrari Radiators does not guarantee that the Site will always be uninterrupted, error-free, secure, or available at a particular time. This disclaimer does not limit the express five-year limited seller warranty described in the Returns and Warranty Policy or any consumer right that cannot lawfully be limited.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Ferrari Radiators and its owners, personnel, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Site, a product, a shipment, or these Terms. Where liability cannot lawfully be excluded, it is limited only to the extent permitted by law.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence where such limitation is unlawful, or any other liability that cannot lawfully be excluded or limited.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Ferrari Radiators and its owners, personnel, suppliers, and service providers harmless from claims, losses, liabilities, costs, and expenses arising from your unlawful use of the Site, breach of these Terms, violation of another party’s rights, or submission of inaccurate information. This section does not require indemnification where prohibited by law.
15. Governing Law and Dispute Resolution
Except where non-waivable law requires otherwise, these Terms are governed by California law without regard to conflict-of-law rules. Before either party starts a formal dispute, the parties should first attempt to resolve the issue in good faith. To start that process, submit a concise description of the issue and relevant order information through the specialist contact form.
Any arbitration, class-action waiver, venue, jury-trial waiver, or other dispute-resolution provision must be separately reviewed by qualified counsel and implemented only with a clear, enforceable acceptance process. This draft does not create a substitute for that review. You may bring an eligible matter in small-claims court where applicable law permits.
16. Changes to These Terms
Ferrari Radiators may update these Terms to reflect changes in the Site, products, vendors, operations, legal requirements, or business practices. We will post the updated version on this page and revise the Last Updated date. A change will not retroactively alter a completed transaction except where the law permits and notice is provided as required.
17. Contact
For questions about these Terms, an order, a product, a return, a warranty request, privacy, cookies, or a legal concern, please use the Ferrari Radiator Specialist contact form. Please include enough information for us to evaluate your request and do not include passwords or full payment-card numbers.
